THE ENCLOSE TO DISCUSSION ON ISLAM CONTRIBUTION IN
LEGAL THOUGHT
– The Review on the Issue of Religious Freedom–
Abstract: The scientific thought in Europe has never respected enough the
contribution of Islamic culture and tradition in creation of modern civilisation
heritage. On the contrary, it seems for the last decades, it is even louder the disco-
urse of insisting on irreconcilable differences of the West and East, and pursuant
to it, it is stronger the voice of those who give up of the idea on multi-cultural one.
Europe, in this discussion, despite a proclaimed secularism, often self-identifies
as a Christian society, and all progress and accomplished advance ideas that are
the outcome of its contacts with East, especially with Islam, itarrogates as its own
ones. In this way, it is unjustifiably marginalised the role, for the certain historical
context, in numerous aspects of advance civilisations. The reactions of scientific
public for such a reduction approach of the Western thought on the role of Islamic
tradition in creation of what we call civilisation heritage, are present for some time
and they often appear from prestigious science departments of the West. They
are of the special interest the ones coming from the lines of legal thought where
it is especially emphasised the contribution of Islamic culture onto legal tradition
in evolution of thought, in general. This paper, in this sense, is a try to present,
especially to the domestic scientific public, some of the arguments this discussion
offers. The review on the Ottoman legal tradition and Novi Pazar, which is evident
in this paper, is done in the attention to put one global topic into the context the
closest to us, and thus the easiest to understand. Especially, as we emphasised, the
topic is one world-wide, re-actual topic.
